Terms of Service

These Terms of Service (“Terms”) are a binding agreement between you and mims (“mims,” “we,” “us,” or “our”) governing your use of our website and the mims iOS app (together, the “Services”). By creating an account, joining the waitlist, or otherwise using the Services, you agree to these Terms. If you do not agree, do not use the Services.

Eligibility

You must be at least 13 years old, or the minimum age of digital consent in your country, to use the Services. If you are under the age of majority where you live, you may only use the Services with the involvement of a parent or legal guardian. By using the Services, you represent that you meet these requirements.

Your account

You are responsible for the activity that happens under your account and for keeping your login credentials secure. Provide accurate information and let us know promptly if you believe your account has been compromised. We may suspend or terminate accounts that violate these Terms.

The game and AI-generated content

mims is a fictional social-deduction game. Characters, feeds, messages, and storylines are fictional and AI-generated, are created fresh per playthrough, and do not represent real people, events, or advice. AI output can be inaccurate or unexpected and should not be relied upon as factual, professional, medical, legal, or financial guidance. Any resemblance between in-game characters and real persons is coincidental.

Acceptable use

You agree not to:

Use the Services for any unlawful purpose or in violation of these Terms.
Submit content that is illegal, infringing, hateful, harassing, or that exploits or endangers minors.
Attempt to reverse engineer, scrape, overload, disrupt, or gain unauthorized access to the Services or their systems.
Use the Services to develop a competing product, or to generate content that violates the policies of our underlying AI providers.
Misrepresent your identity or impersonate any person or entity.

User content

You retain ownership of the content you submit (such as messages you send to in-game characters). You grant us a worldwide, non-exclusive, royalty-free license to host, process, and use that content as needed to operate, improve, and provide the Services, including sending it to the AI providers that power gameplay. You are responsible for the content you submit and represent that you have the right to submit it.

Intellectual property

The Services, including their software, design, branding, and original content, are owned by mims and protected by intellectual property laws. We grant you a limited, personal, non-transferable, revocable license to use the Services for your own non-commercial entertainment. All rights not expressly granted are reserved.

Purchases and virtual items

The Services may offer virtual items or in-app purchases (for example, gems). Virtual items have no monetary value, are licensed not sold, and are non-transferable and non-refundable except where required by law or by the applicable app store’s policies. Purchases made through the Apple App Store are also subject to Apple’s terms.

Third-party services

The Services rely on third parties, including Apple and AI model providers. Your use of the app through the App Store is also governed by Apple’s terms, and Apple is not responsible for the Services. Apple is a third-party beneficiary of these Terms and may enforce them against you.

Disclaimers

The Services are provided “as is” and “as available,” without warranties of any kind, whether express or implied, including warranties of merchantability, fitness for a particular purpose, and non-infringement. We do not warrant that the Services will be uninterrupted, error-free, or secure.

Limitation of liability

To the maximum extent permitted by law, mims will not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of data, profits, or goodwill, arising from your use of the Services. Our total liability for any claim relating to the Services will not exceed the greater of the amount you paid us in the twelve months before the claim or US $100.

Termination

You may stop using the Services at any time. We may suspend or terminate your access if you violate these Terms or if we discontinue the Services. Provisions that by their nature should survive termination will survive.

Changes to these Terms

We may update these Terms from time to time. When we do, we will revise the “Last updated” date above and, where appropriate, provide additional notice. Your continued use of the Services after changes take effect means you accept the revised Terms.
